Scam robocalls are “a scourge visited upon millions of Americans every day,” and are “real threats to American consumers. These calls, which often purport to be from someone “calling from Medicare, Solar Services or Final Expense with false names "Jennifer" "Elsa" 'Alex" & "Amber" violate the Telephone Consumer Protection Act because they are placed to recipients’ cell phones via an autodialer or prerecorded message without the consumer's consent. Then there are "spoofed calls" that your friendly VoIP providers like Onvoy, Peerless, Bandwidth and other service providers that faciliate and have supporting roles in these illegal robo calls made to your home or business. While these calls menace consumers, they benefit two sets of players: the scammers who originate them but conceal their identities and the downstream companies who get paid every time they play their essential role in making the calls to recipients like the present litigant in this case and normal people that are going about their lives but for these scammers, they inject disarray into our privacy and seclusion.
Spoofing is when a caller deliberately falsifies the information transmitted to your caller ID display to disguise their identity. Scammers often use neighbor spoofing so it appears that an incoming call is coming from a local number, or spoof a number from a company or a government agency that you may already know and trust. If you answer, they use scam scripts to try to steal your money or valuable personal information, which can be used in fraudulent activity. Thanks to the calling platforms of the likes of VoIP service providers, i.e. Onvoy, Peerless & Bandwidth allow this type of unlawful activity.
An automated call, or "robocall," is a call dialed by a computer. On the other hand, a prerecorded voice message is a recorded artificial and or human-sounding voice message that the caller uses when contacting the consumer. Calls made by artificial intelligence (AI) fall under the category of prerecorded voice messages under the TCPA. VoIP providers have the ability and or software to create AI bot voices.
Don't let these scammers get your personal information and commit fraud and or Identity theft upon your good name. If you don't want to join this action - consult your choice of legal counsel and exercise your 1st amendment rights to seek redress for your injuries & file against these corporations. Against the CEO's who control them.
These VoIP providers make millions of dollars daily - contact your Congressman or Congresswoman and file complaints against these telecomm titans. I am sure that the Board of Managers, VP's, Upper management don't get robocalls at their house.
Telemarketers don't care if they call you at work and intrude upon your daily work activities. There needs to be a change or more lawsuits to get these companies attention.
